Submits Ordinance No.8 of 1934, Immigration and Passports.
Ordinance 35 of 1923 empowers the
Governor-in-Council to make passport regulations,
which were under Section 2(3) of the Ordinance
to be subject to review by the Legislative Council.
The regulations at present in force are those
appearing in Government Notice 361 of 1932. The
present Ordinance repeals the 1923 Ordinance and
enacts comprehensive immigration and landing
restrictions and passport regulations. The main
sources from which the provisions of the Ordinance
are drawn are:-
Part I. From the Travellers Restriction Ordinance
1915 which is repealed by the Registration of
Persons Ordinance (No.3 of 1934) and now under
and
consideration/from the Straits Settlements Passengers
Restriction Ordinance No.169 (as amended by Straits Settlements Ordinance 1/32) Part II from the present
Passport Regulations (vide supra) which are
followed closely with the exception of sections 11(2)
and 11(3) which are new and section (12) in which
section 4 of the present passport regulations is
expanded on the lines of section 2 of Straits
Settlements Ordinance 1 of 1932:
and Part III from Hong Kong Ordinances 19 of 1915 and
35 of 1923, and from the present Passport Regulations.
This is a "reserved"Ordinance, and if and when it is
eventually sanctioned we shall have to take care to
adopt the right formula in informing the Governor.
